Underwriting Requirements:

The United States government historically has requested that forms created by it be used when the USA is being insured.  Typically the USA includes various governmental agencies.  The forms are issued in inverse order from the normal title insuring forms.

The T-11 USA policy operates as a commitment and is issued prior to the document vesting title in the USA.  Once title is acquired, the Endorsement form T-12 is issued.   The USA Policy provides assurance to the USA that the seller is vested with title.  The USA endorsement insures that title is now vested in the USA. 

It is important to be aware that the USA Tile Policy does not provide title insurance against:

            Matters Not of Record;

            Matters Subsequent to the Date of Policy;

            Refusal to Purchase (marketability); and

            Creditors’ Rights

Once the documents creating title in the USA are furnished, the endorsement T-12 is issued which modifies the language of the Policy:

            Specifies the estate insured.

            Names the United States of America as the named insured

            Provides an insurable legal description

            Deletes item 2d of the policy (conveyances, agreements, defects, liens or encumbrances where no notice appears of record)

            Brings the effective date of the policy to the recording date of the vesting deed into the USA.

            States the policy amount

Any revision to this form requires approval of a Stewart Title Guaranty Company underwriter. The underwriting guidelines contained herein have been provided for general reference. The facts, circumstances, and location of the subject property should be considered when determining the issuance of the requested form or endorsement. Please note that all of the forms and endorsements included in this system may not be available in all states. Accordingly, please contact the appropriate Stewart Title Guaranty Company underwriting personnel in order to determine availability.
