Explanation:

Provides the lender with insurance against court ordered removal of any portion of the improvements located on the insured property which encroach onto adjoining property.

Underwriting Requirements:

(1) Current survey certified to the Company by an approved, registered land surveyor showing the existence of such encroachment.
(2) The encroachment must be minor, no more than one foot, and of a minor improvement onto the insured property i.e., fence, small shed or driveway and not a part of a house or other major building.
(3) The appropriate Stewart Title Guaranty underwriting personnel must be contacted prior to issuance.

Any revision to this form requires approval of a Stewart Title Guaranty Company underwriter. The underwriting guidelines contained herein have been provided for general reference. The facts, circumstances, and location of the subject property should be considered when determining the issuance of the requested form or endorsement. Please note that all of the forms and endorsements included in this system may not be available in all states. Accordingly, please contact the appropriate Stewart Title Guaranty Company underwriting personnel in order to determine availability.
