Explanation:

The Personal Property Encumbrance Guarantee is designed to provide the Assured with information regarding that personal property described in the Guarantee as to certain parties designated in the Guarantee.

The assurance relates only to the indices of the County Recorder of a specified county and the indices of the United States District Court (if such a court is located in the county).

The Guarantee assures that, with respect to the designated parties and insofar as the designated parties are identified with the described personal property that there are no

(a) financing statements or other evidences of specified personal property encumbrances, or
(b) notices of Federal Tax liens, or
(c) matters disclosing bankruptcy proceedings.

Any such matters that exist are shown as exceptions in the Guarantee.

The Guarantee Face Page (revised 6-6-92) and Guarantee Conditions and Stipulations (revised 6-6-92) must be used with the Personal Property Encumbrance Guarantee Schedule A.

Any revision to this form requires approval of a Stewart Title Guaranty Company underwriter. The underwriting guidelines contained herein have been provided for general reference. The facts, circumstances, and location of the subject property should be considered when determining the issuance of the requested form or endorsement. Please note that all of the forms and endorsements included in this system may not be available in all states. Accordingly, please contact the appropriate Stewart Title Guaranty Company underwriting personnel in order to determine availability.

Compliance with the underwriting guidelines contained herein in no way obligates Stewart Title Guaranty Company to issue any form or endorsement.
