Explanation:

The Navigational Servitude Endorsement provides affirmative coverage against loss suffered by the insured resulting from the forced removal of improvements based upon the U.S. Government exercising its right with respect to its control over navigable waters or lands which were formerly navigable waters. Please note that coverage is not provided for loss resulting from the State of Florida exercising its rights regarding sovereignty lands. You will be asked to provide this endorsement when the land described in Schedule A of the policy is adjacent to the ocean, gulf, intracoastal, rivers, lakes, ponds, streams or other navigable bodies of water or on filled-in lands.

Underwriting Requirements:

Since this endorsement provides affirmative coverage against loss resulting from the forced removal of improvements located on the insured property, issuance of this endorsement should be approved by the appropriate Stewart Title Guaranty underwriting personnel.

Any revision to this form requires approval of a Stewart Title Guaranty Company underwriter. The underwriting guidelines contained herein have been provided for general reference. The facts, circumstances, and location of the subject property should be considered when determining the issuance of the requested form or endorsement. Please note that all of the forms and endorsements included in this system may not be available in all states. Accordingly, please contact the appropriate Stewart Title Guaranty Company underwriting personnel in order to determine availability.

Compliance with the underwriting guidelines contained herein in no way obligates Stewart Title Guaranty Company to issue any form or endorsement.
