The Policy is hereby amended as follows to the extent it is inconsistent with the following:
The word "sole" is hereby deleted from the Section(s) found in the Conditions of this policy that may be entitled "Defense and Prosecution of Action", or "Company's Option to Defend or Prosecute Actions".
In order to comply with the Montana Statutes 33-23-103 and/or 33-24-105, the following provisional language is added to the policy:
"Conformity with Montana statutes. The provisions of this policy conform to the minimum requirements of Montana law and control over any conflicting statutes of any state in which the insured resides on or after the effective date of this policy".
Any provisions in the Conditions of this policy referring to Arbitration are hereby deleted. This endorsement is issued as part of the policy. Except as it expressly states, it does not (i) modify any of the terms and provisions of the policy, (ii) modify any prior endorsements, (iii) extend the Date of Policy, or (iv) increase the Amount of Insurance. To the extent a provision of the policy or a previous endorsement is inconsistent with an express provision of this endorsement, this endorsement controls. Otherwise, this endorsement is subject to all of the terms and provisions of the policy and of any prior endorsements.
This endorsement is issued as part of the policy.
