SUBJECT TO THE EXCLUSIONS FROM COVERAGE, MATTERS SET FORTH ON SCHEDULE A, THE EXCEPTIONS FROM COVERAGE CONTAINED IN SCHEDULE B AND THE CONDITIONS AND STIPULATIONS of Policy No. _______ (“Policy”) issued by _________, a _______________corporation, all of which are incorporated into this endorsement by reference and subject to the matters set forth below, Stewart Title Guaranty agrees to insure the Insured named in Schedule A of the Policy, against loss or damage, not exceeding the Amount of Insurance stated in Schedule A of the Policy (unless modified herein) sustained or incurred by reason of: any defect, lien or encumbrance or other matter affecting the title or the lien of the insured mortgage, which first appears in the public records between the date of ______ (prior search date or endorsement date) and _____________(new search date or date of disbursement, whichever agreed upon).

Nothing herein contained nor in the policy previously issued shall subject Stewart Title Guaranty Company to liability for the completion of the improvements presently under construction on the insured land or to liability for non-compliance with plans and specifications in connection with the construction. Stewart Title Guaranty Company in no way guarantees the sufficiency of the mortgage proceeds as adequate to complete said improvements.
This endorsement is made a part of the Policy and is subject to all of the terms and provisions thereof and of any prior endorsements thereto. Except to the extent expressly stated, it neither modifies any of the terms and provisions of the policy and any prior endorsements, nor does it extend the effective date of the policy and any prior endorsements, nor does it increase the face amount thereof.
Signed under seal for the Company, but this Endorsement is to be valid only when it bears an authorized countersignature.
This endorsement is issued as part of the policy. Except as it expressly states, it does not (i) modify any of the terms and provisions of the policy, (ii) modify any prior endorsements, (iii) extend the Date of Policy or (iv) increase the Amount of Insurance. To the extent a provision of the policy or a previous endorsement is inconsistent with an express provision of this endorsement, this endorsement controls. Otherwise, this endorsement is subject to all of the terms and provisions of the policy and of any prior endorsements.
