Subject to the insuring provisions, conditions and stipulations, exclusions from coverage, and exceptions in Schedule B, and the terms of paragraph _____ of the lease, this policy insures against loss or damage sustained by insured in the event that the estate or interest herein insured is determined by any final non-appealable order or decree of a court of competent jurisdiction to be subject to any mortgage or mortgages given after date of this policy by the lessor as defined in the lease set forth in Schedule A of this policy so long as the lease remains in effect and unmodified, and the lessee complies with the terms of the lease.
Notwithstanding the provisions of paragraph 3(d) of the exclusions from coverage of the policy, Company hereby agrees with the insured that in the event of loss or damage insured against under the terms of this endorsement that the Company will not deny its liability under this endorsement on the ground that the matters insured against herein attach or are created subsequent to the date of this policy.

This endorsement is made a part of the policy and is subject to all of the terms and provisions thereof and of any prior endorsements thereto. Except to the extent expressly stated, it neither modifies any of the terms and provisions of the policy and any prior endorsements, nor does it extend the effective date of the policy and any prior endorsements, nor does it increase the face amount thereof.

This endorsement is issued as part of the policy. Except as it expressly states, it does not (i) modify any of the terms and provisions of the policy, (ii) modify any prior endorsements, (iii) extend the Date of Policy or (iv) increase the Amount of Insurance. To the extent a provision of the policy or a previous endorsement is inconsistent with an express provision of this endorsement, this endorsement controls. Otherwise, this endorsement is subject to all of the terms and provisions of the policy and of any prior endorsements.
