ENDORSEMENT

Attached to and Forming a Part of

Title Owner's Policy No. __________

STEWART TITLE GUARANTY COMPANY

In consideration of the issuance of this policy at the request of the insured for an amount less than the market value of the land described in Schedule A, the insured accepts this policy upon the condition that in the event loss or damage occurs to the insured by reason of any defects in the title to the estate or interest in the land not shown in Schedule B, the Company shall be liable only for the proportion of the loss or damage which the amount of the policy bears to the market value of the land at the time of any such loss or damage; and upon the further condition that in the event the Company is called upon under the policy to provide for the defense of the insured in any litigation affecting the title to the estate or interest in the land, the insured agrees to pay the same proportion of the cost for the defense, including court costs and attorney's fees, as the market value of the land less the face amount of the policy bears to the market value of the land and indemnify the Company therefor before it undertakes to provide such defense.






This endorsement is made a part of the policy and is subject to all of the terms and provisions thereof and of any prior endorsements thereto. Except to the extent expressly stated, it neither modifies any of the terms and provisions of the policy and any prior endorsements, nor does it extend the effective date of the policy and any prior endorsements, nor does it increase the face amount thereof.

This endorsement is issued as part of the policy. Except as it expressly states, it does not (i) modify any of the terms and provisions of the policy, (ii) modify any prior endorsements, (iii) extend the Date of Policy or (iv) increase the Amount of Insurance. To the extent a provision of the policy or a previous endorsement is inconsistent with an express provision of this endorsement, this endorsement controls. Otherwise, this endorsement is subject to all of the terms and provisions of the policy and of any prior endorsements.
